The Institute for Legislative Analysis (ILA) supports the Respect State Housing Laws Act (H.R. 1078; Rep. Barry Loudermilk, R-GA) because it helps combat federal overreach and strengthen property rights. As introduced, this legislation repeals the CARES Act’s federal 30-day notice-to-vacate requirement applicable to certain federally covered rental properties, including properties participating in specified federal housing programs and those with federally backed mortgage loans. As a result, eviction notice requirements for these properties would be determined under applicable state law rather than federal law. ILA commends Congressman Barry Loudermilk for introducing this important legislation and championing policies that protect property owners from unnecessary risk, helping prevent hikes in housing costs and rental rates.
