Xcel Received Special Wildfire Liability Protections. CPR is Fighting for Ranchers.
In 2024, the Smokehouse Creek Fire became the largest wildfire in Texas history, burning more than one million acres, killing thousands of cattle, and devastating ranching families across the Panhandle.
Xcel Energy, whose equipment was involved in starting the fire, promised victims a fast claims process and fair compensation. While some claims have been paid, CPR has heard firsthand from ranchers who were offered pennies on the dollar or received little to no response.
Texas Attorney General Ken Paxton first opened an investigation into whether Xcel’s ESG and DEI priorities came at the expense of infrastructure and public safety. He has since sued Xcel over the Smokehouse Creek Fire.
CPR is Fighting on Two Fronts
Repeal Xcel’s Special Liability Protections
After the fire, Xcel and other utilities pushed for new wildfire liability protections in Texas and received them. CPR is fighting to reverse these protections and prevent similar policies from spreading across the country.
CPR has drafted a model bill: Protecting Property Owners from ESG and DEI-Ignited Wildfires Act, which CPR plans to introduce in 30 state legislatures to remove these special protections from utilities governed by ESG or DEI frameworks.
